Air Passenger Protection Rights

The civil aviation rules provide for clearer and more consistent air passenger rights by imposing certain minimum airline requirements in air travel – including standards of treatment and, in some situations, compensation for passengers.

Know your flight rights:

Europe - EC261/2004 Rule

For flights that happened in the EU & UK or with EU Airlines, if your flight's eligible, an airline has to pay for flight delays, cancellations, or denied boarding:

  • Flights of -1500kms: €250 EUR

    • ex: Madrid - Barcelona​

  • Between 1500 -3500kms: €400 EUR

    • ex: Oporto - Rome

    • Flights of +3500kms: €600 EUR​
    • ex: Toronto - London

Canada - APPR Rule

Under this rule, compensation exists for delays and cancellations that happened in Canada in situations within the carrier’s control that are not required for safety. ​

Carriers are subject to the following compensation per passenger:

  • Between 3 and 6 hrs: $125 - $400 CAD

  • Between 6 and 9 hrs: $250 - $700 CAD

  • 9 or more hours: $500 - 1,000 CAD

Montreal Convention

The Montreal Convention is a treaty that created strict rules for how airlines handle claims for luggage delay, loss, or damage compensation.

The Montreal Convention sets the maximum liability during international travel at approximately $2,100 CAD

Canada

🍁 Canada's Standards of Treatment

KNOW YOUR RIGHTS

If the airline did not notify you of a flight disruption at least 12 hours before the scheduled departure time, they must provide you with certain standards of treatment, except when the disruption is outside their control. In this case, when a flight is cancelled or when a flight delay reaches two hours, the airline must provide:

  • food and drink in reasonable quantities; and

  • access to means of communication (e.g., free Wi-Fi).

If you are expected to wait overnight for your new flight, the airline must:

  • offer hotel or comparable accommodation free of charge; and

  • provide free transportation to and from the accommodation.

Compensation rights for flight issues are time-bound. Depending on flight destination, airline nationality, and the incident type, you generally have 1 year for flight disruptions and 7-21 days for baggage incidents.
